The Insurance Company Offered Me a Settlement. Should I Take It?

Watch this video by dedicated Buffalo injury attorney Timothy Hiller, Esq. as he explains insurance company settlement offers.

So some people will call me, and they’ll say, well, the insurance company already offered me a settlement; should I take it? The answer, nine times out of ten, is no. You need to have an attorney get involved in your case, collect all your medical records, collect all the facts about the accident, and evaluate that before you can even begin to place a value on your case. I know that based on some of the commercials people see, you might think, well, geez, I’m going to call an attorney, and they’re going to tell me right away what my case is worth. I’m going to tell you right now we’re not going to do that because we’re not going to short-change your case.

We’re going to get all of your medical records. We’re going to consult with experts, if we need to, to know about your medical condition, and we’re going to do extensive research on similar cases to yours to put a fair value on your case, and that can’t be done in an initial phone call. So if you have an offer, if you’re thinking about going with a law firm that says that they can tell you what your case is worth right away, I would just encourage you to think twice and slow down. Because, as I said, if you’ve had a serious or permanent injury, you’re going to be living with that injury for the rest of your life, and you only get one chance to sell your case.

So, again, what may seem like a good settlement today, five, six years down the line, you’re still dealing with the effects of your injury, and the money’s gone; you’re going to really regret that. It’s worth the time and energy to let an attorney take a look at this seriously and determine what this case is really worth?

If the insurance company isn’t willing to offer that, it’s worth your time and energy to take them to court. We do that. If the insurance companies aren’t going to give you what your case is worth, we will fight.
